Thank you for your interest in our online shop. The protection of your privacy is very important to us. In the following we inform you in detail about the handling of your data.
responsible for data processing:
Vitus Wahlländer – TheTreehouse.Shop
1. access data and hosting
You can visit our websites without providing any personal information. Each time a website is accessed, the web server only automatically saves a so-called server log file, which contains the name of the requested file, your IP address, date and time of access, transferred data volume and the requesting provider (access data) and documents the access.
These access data are evaluated exclusively for the purpose of ensuring trouble-free operation of the site and improving our services. In accordance with Art. 6 Para. 1 S. 1 lit. f DSGVO, this serves to safeguard our predominantly legitimate interests in a correct presentation of our offer as part of a weighing of interests. All access data will be deleted at the latest seven days after the end of your page visit.
Hosting services by a third-party provider
In the context of processing on our behalf, a third party provider provides us with the services of hosting and display of the website. All data collected within the framework of the use of this website or in the forms provided for this purpose in the online shop as described below will be processed on its servers. Processing on other servers will only take place within the scope described here.
This service provider is located within a country of the European Union or the European Economic Area.
2. collection and use of data for the purpose of processing contracts, establishing contact and opening a customer account
We collect personal data when you voluntarily provide us with it in connection with your order or when contacting us (e.g. via contact form or e-mail). Mandatory fields are marked as such, because in these cases we need the data to process the contract or to process your contact and you can not send the order or contact without their information. Which data are raised, are evident from the respective input forms. We use the data provided by you in accordance with Art. 6 Para. 1 S. 1 lit. b DSGVO for contract processing and processing your enquiries.
If you have given your consent in accordance with Art. 6 Para. 1 S. 1 lit. a DSGVO by deciding to open a customer account, we will use your data for the purpose of opening a customer account.
After complete completion of the contract or deletion of your customer account, your data will be restricted for further processing and deleted after expiry of the retention periods under tax and commercial law, unless you have expressly consented to further use of your data or we reserve the right to use data beyond this, which is permitted by law and about which we inform you in this declaration. The deletion of your customer account is possible at any time and can take place either by a message to the contact possibility described below or over a function intended for it in the customer account.
3. data transfer
In order to fulfil the contract pursuant to Art. 6 Para. 1 S. 1 lit. b DSGVO, we pass on your data to the shipping company commissioned with the delivery, insofar as this is necessary for the delivery of ordered goods. Depending on which payment service provider you select in the ordering process, we will pass on the payment data collected for this purpose to the credit institution and payment service provider commissioned by us or to the selected payment service in order to process payments. In some cases, the selected payment service providers also collect this data themselves if you create an account there. In this case, you must register with the payment service provider using your access data during the ordering process. In this respect, the data protection declaration of the respective payment service provider applies.
Data transfer to shipping service providers
If you have given us your express consent to this during or after your order, we will forward your telephone number to the selected shipping service provider on the basis of this pursuant to Art. 6 Para. 1 S. 1 lit. a DSGVO so that the latter can contact you before delivery for the purpose of announcing or coordinating delivery.
The consent can be revoked at any time by sending a message to the contact option described below or directly to the shipping service provider at the contact address listed below. After revocation, we will delete your data unless you have expressly consented to the further use of your data or unless we reserve the right to use your data for other purposes, which is permitted by law and about which we will inform you in this declaration.

Data transfer for the purpose of age verification
If your order includes goods whose sale is subject to age restrictions, we will ensure by using a reliable procedure including a personal identity and age check that the orderer has reached the required minimum age. For this purpose, the SCHUFA IdentityCheck is used on our website. This service is operated by SCHUFA Holding AG, Kormoranweg 5, 65201 Wiesbaden.
In order to ensure the required minimum age, individual personal data (e.g. name, address and date of birth) will be transmitted to SCHUFA Holding AG within this framework. A so-called identity check with Q-bit is then carried out, which was positively evaluated by the Commission for the Protection of Minors in the Media (KJM) for the age test.
In accordance with Art. 6 Para. 1 S. 1 lit. f DSGVO, the data transfer serves to safeguard our predominantly legitimate interests in ensuring an offer that conforms to the protection of minors as well as the protection of the statutory provisions for the protection of minors.
In this respect, there is no credit assessment.
After the complete execution of the contract and after expiry of the tax and commercial retention periods, your data processed for this purpose will be deleted, unless you have expressly consented to further use of your data or we reserve the right to use data beyond this, which is permitted by law and about which we inform you in this declaration.
4. e-mail newsletter
E-mail advertising without newsletter registration and your right of objection
If we receive your e-mail address in connection with the sale of a product or service and you have not objected to this, we reserve the right to send you regular offers for similar products to those already purchased from our range by e-mail on the basis of § 7 para. 3 UWG. This serves to protect our predominantly legitimate interests in an advertising approach to our customers within the framework of a weighing of interests.
You can object to this use of your e-mail address at any time by sending a message to the contact option described below or via a link provided for this purpose in the advertising mail without incurring any costs other than the transmission costs according to the basic tariffs.
The newsletter is sent as part of a processing on our behalf by a service provider to whom we forward your e-mail address for this purpose. This service provider is located within a country of the European Union or the European Economic Area.

You can find the duration of the storage in the overview in the cookie settings of your web browser. You can set your browser so that you are informed about the setting of cookies and decide individually whether to accept them or whether to exclude the acceptance of cookies in certain cases or in general. Each browser differs in the way it manages the cookie settings. This is described in the help menu of each browser.
If cookies are not accepted, the functionality of our website may be restricted.

This website uses Google Maps for the visual representation of geographical information. Google Maps is a service provided by Google Ireland Limited, a company incorporated and organised under the laws of Ireland and having its registered office at Gordon House, Barrow Street, Dublin 4, Ireland (www.google.de). This serves to safeguard our predominantly legitimate interests in an optimised presentation of our offer as well as easy accessibility to our locations in accordance with Art. 6 para. 1 sentence 1 lit. f) DSGVO.
When Google Maps is used, Google transmits or processes data on the use of the Maps functions by website visitors, which may include in particular the IP address and location data. We have no influence on this data processing.

A current certificate can be viewed here. On the basis of this agreement between the USA and the European Commission, the latter has established an appropriate level of data protection for companies certified under the Privacy Shield.
In order to deactivate the Google Maps service and thus prevent data transmission to Google, you must deactivate the Java Script function in your browser. In this case, Google Maps cannot be used or can only be used to a limited extent.
Data processing is based on an agreement between jointly responsible persons pursuant to Art. 26 DSGVO, which you can view here.
This website uses Hotjar. The provider is Hotjar Ltd, Level 2, St Julians Business Centre, 3, Elia Zammit Street, St Julians STJ 1000, Malta, Europe (Website: https://www.hotjar.com).
Hotjar is a tool to analyze your user behavior on this website. With Hotjar we can, among other things, record your mouse and scroll movements and clicks. Hotjar is also able to determine how long you stayed with the mouse pointer in a certain position. Hotjar uses this information to create so-called heat maps, which can be used to determine which areas of the website the website visitor prefers to view.
We can also determine how long you stayed on a page and when you left it. We can also determine at which point you have interrupted your entries in a contact form (so-called conversion-funnels).
In addition, Hotjar can be used to obtain direct feedback from website visitors. This function serves to improve the website operator’s web offerings.
Hotjar uses technologies that enable the recognition of the user for the purpose of analyzing user behavior (e.g. cookies or the use of device fingerprinting).
The use of this analysis tool is based on Art. 6 Par. 1 lit. f DSGVO. The website operator has a legitimate interest in the analysis of user behaviour in order to optimise both his website and his advertising. If a corresponding consent has been requested (e.g. consent to the storage of cookies), the processing is carried out exclusively on the basis of Art. 6 para. 1 lit. a DSGVO; the consent can be revoked at any time.
If you want to disable Hotjar data collection, click on the following link and follow the instructions there: https://www.hotjar.com/opt-out
Please note that Hotjar must be deactivated separately for each browser or end device.
